Therefore, the use of the Elven Platform and the provision of your personal data in the Elven Academy section will imply the acknowledgment that you have read, understood and unconditionally accepted all provisions set out in this document. To proceed with access through the console section, the following data will be requested: the data subject's full name, email address and contact phone number. On this occasion, should the data subject be representing a legal entity, data about the company may be requested.
The data subject's name provided serves the purpose of identifying who created the registration on our website with the intent to access our platform. The email address serves the purpose of enabling access to the platform, since it must be used to log in together with the password chosen by the data subject. After the information is provided, and for security purposes, ELVENWORKS may send a confirmation code via SMS to the registered phone number and/or a confirmation email to the registered email address in order to confirm the data subject's identity.
Given the above, considering the need to process personal data to ensure access to our platform, and taking into account the terms of the Brazilian General Data Protection Law — Law 13.709/2018 —, we point out that the processing of your personal data in this case is legitimized by the legal basis of “performance of a contract and preliminary procedures” (article 7, V of the LGPD).
To access our platform (“Elven Platform”) in the free trial mode through the section available on our website, your full name and email address will be requested. After registering on our website, an access link to the platform will be sent to the registered email address. The data subject's name provided serves the purpose of identifying who created the registration on our website, with the intent to access our platform.
The email address serves the purpose of enabling access to the platform, since it must be used to log in together with the password chosen by the data subject.
ELVENWORKS may contact the data subject via WhatsApp, SMS or phone to address any matter related to the platform (“Elven Platform”), as well as for marketing purposes, offering new features and services. Should the data subject no longer wish to receive marketing-related contact, they must send an email to contact@elven.works stating that they do not wish to be contacted for such purposes.
In the case of processing personal data to contact the user via WhatsApp, SMS or phone in order to address matters related to the services contracted by the user, as well as to ensure the proper performance of the contracted service and to resolve questions and any failures, and taking into account the terms of the Brazilian General Data Protection Law — Law 13.709/2018 —, we point out that the processing of your personal data in this case is legitimized by the legal basis of “performance of a contract and preliminary procedures” (article 7, V of the LGPD). In the case of processing personal data to contact the data subject via WhatsApp, SMS or phone for marketing purposes, and taking into account the terms of the Brazilian General Data Protection Law — Law 13.709/2018 —, we point out that the processing of your personal data in this case is legitimized by the legal basis of “legitimate interest” (article 7, IX of the LGPD).
The data subject may choose to receive notifications from the Platform — specifically regarding its operation — via SMS, WhatsApp and phone call. This is an option that may be adopted by the data subject directly in the settings available in the dashboard. In addition, the data subject may disable such notifications directly in the Platform settings should they choose to no longer receive them.
Should the data subject be interested in learning more about the programs offered by Elven Academy, they may click on “I Want More Information”, at which point they must provide their full name, email and phone number. In this case, by submitting their information, the data subject will be agreeing to their registration in our company's Database, as well as to the use of their personal data so that the company may make contact. Contact may be made by phone and/or email, and will serve the purpose of explaining and clarifying the programs offered by Elven Academy that are already highlighted on the website.
When choosing to enroll in any of the programs offered by Elven Academy, the data subject will be directed to a page where they must provide their full name, address, phone number, CPF and select the payment method.
The data collected at this time will be processed for the exclusive purpose of enabling payment and the proper identification of the data subject responsible for such payment. Furthermore, it is essential to clarify that we rely on the “Kiwify” platform to process payments. Kiwify uses Google reCAPTCHA and complies with its privacy terms. In order to comply with the scope of what is agreed between ELVENWORKS and the Client upon contracting Professional Services, our company may have access to personal and confidential data owned by and under the responsibility of the Client. In such a case, we at ELVENWORKS limit ourselves to processing this data and information only within this Client's infrastructure. Therefore, such information will not, under any circumstances, be transferred, saved and/or stored by ELVENWORKS.
Furthermore, in the case of Professional Services engagements, ELVENWORKS undertakes to comply with the confidentiality terms and information security policies of the contracting company.

Your data will be stored while your account is active. Should you delete your account, your data will be immediately deleted, unless it is necessary to store it for the purpose of complying with a legal obligation and/or for the exercise of a defense by ELVENWORKS in administrative, judicial or arbitral proceedings, as permitted by the Brazilian General Data Protection Law (article 7, items II and VI of the LGPD).

The competent jurisdiction to resolve any disputes related to this Privacy Policy is the central court of the district of São Paulo/SP.
